Essay on Criminal Justice The Goals of Sentencing

Sentencing is the imposition of a criminal sanction by a sentencing authority , such as a judge. Schmallger Smykla, 2009, pg# 71) There are seven goals of sentencing including revenge, retribution, just deserts, deterrence, incapacitation, rehabilitation and restoration. Revenge refers to a retaliation to some kind of assault and injury. Revenge can be a type of punishment for the criminal justice system. The jury, sometimes, basis there choices on emotions, facts and evidence. It is considered revenge in some cases because the victims looks at it that way when they feel justice has been served. Retribution is a type of sentencing involving another form of retaliation. Deterrence is a type of sentencing that prevent future actions of crimes. There is a general deterrence and specific deterrence. Specific deter rence is punishment that prevents the criminal to commit additional crimes by enforcing fear. Back in the day, depending on the crime, the criminals would get parts of their body removed. For example, rapist were castrated. General deterrence is when examples are shown to prevent someone, that is contemplating on committing crimes, to change their minds. Sometimes when a person is put in jail it does not change their criminal minds. Incapacitation involves imprisonment for offenders who commit crimes to prevent the possibilities of future offenses. (Schmalleger Smykla, 2009, pg# 74) Incapacitation has reduced the crime rate considerably. Some offenders get out on bail or bond, serve the minimum of the sentence and out on parole or probation. Offenders realize that is getting more and more expensive to cover up their crime. Therefore, they are expecting to be caught. Rehabilitation or reformation is another form of sentencing. Rehabilitation is a process of treatment for offenders to get them back on track. It gets to the core of why the offender acted this way. There may be many problems with them who are working in a plant so to provide safety to them we use the CDC Act. There is a need to start some policies and to make some strategies to provide the safe environment to the workers. So the problem is what the essential steps should take by the head of the company. Unsafe condition and unsafe Acts in plant: There are lot of unsafe condition and unsafe acts in the plant according to CDC given below: There may be some unsafe conditions in a company. If there is any damage and an accident occurs in the company work place then it creates an unsafe work environment. The problem of happening the loss or injury at any workplace is called the unsafe condition of the work place (Donohue et al., 2015). In the company if proper maintenance of the building is not being then there may be some damage in the building and it may leading cause of accident. The workers of the company could be injured in any incident. Due to earth-quack or fire, a lot of hazard to the men, machine and building can happen. An incident is the main cause of the decay of men power (Dowell, Haegerich Chou, 2016). If there is any task activity is doing and if any worker gets injured during that work that comes under unsafe act (Gillespie, Wigington Hong, 2013). Unsafe acts depend on upon how a human act and how any human behave with others. Mostly unsafe acts are related to our actions what we do in our daily life. The workers working in the company do not pay attention to the instruction. At the time of training sometimes, people do not hear about the instruction given by the trainer which leads to an incident (Gonzalez-Delgado et al., 2015). In whole training program, the disease and to cure them is explained by the trainer. But due to the less attention or the less interest, some trainee does not hear the trainer properly and they miss some points which may be cause of the incident (Gulzar Manzoor, 2014). The unsafe handling of the materials is also an issue which may the cause of accident. There is another problem that can affect the safety. If we do not load and store the material with caution then it is also an unsafe act. There is need to use the objects and equipments correctly in the organization so that an incident can be avoided (Kagan, 2016). The workers should follow the direction given by the company so that the incident cannot take place. If there is an accident occurs then it w ill be the reason of physical disabilities and the mental disabilities also. So to avoid the pain and suffer, everyone should be aware of the caution and use all the safety measures (Kol et al., 2014). There is a ventilation problem in the lab of plant according to CDC that is the cause of the infections and the chronic disease because unfiltered air is below inside the labs through the ventilation that is very harmful (Gillespie, Hurvitz, Centers for Disease Control and Prevention (CDC), 2013). Through the ventilation, a lot of dust particles entered to the plant that was very harmful. Due to the dangerous site of the place and dangerous gas, many disease particles took place. A section of the facility including bio-safety was involved in the security incident. If there are not policies of company to provide the safety to the workers that under comes the critical condition. Lack of awareness is also an unsafe condition of the plant. If the workers are working in the plant and they are not aware of the effects and potential for an explosion caused by a natural gas leak, it creates an unsafe environment in the plant (Kumar, 2014). There are some other unsafe issues and acts which may be in the company: Unforeseen condition can be happened at any work place at any time that can be cause of a high loss of the physical (human) and the financial loss (Liao et al., 2013). A client, public and employees, anyone can be affected due to the incident that is unpredictable such as earth-quack, tsunami, floods, fire, toxic gas and many other incidents. So, there is high demand to use the caution while working in the company (Loud, 2012). Under the CDC act, all the security majors are defined below: Steps to rectify the noted safety concerns: If there is any crisis happens in the company then there should be an alert in the company. Management should ready to respond to an emergency situation. A head is always ready to respond to the worst situation; an admin should be appointed for the worst situation. An emergency plan implements including all the emergencies that can be occurred in the workplace (Sana et al., 2015). A manager and the company head must inspect the company site at the certain time interval so that they would be able to predict all the emergencies. So a hazard assessment must be determined. All the machinery and the assets require repairing so the continuous repairing is very necessary (Schuch et al., 2014). The accident may occur due to less consciousness of the workers so the working hours should be less and the work environment should be good. There should not be the access to anything, like if the speed of the machine is set to some limit then workers should not use the machine at unsafe speed. The repairing of the equipment should be at the time to time. No one should use any equipment after the expiry date of the product and machinery. An unclean work place environment is also an unsafe condition so there must be proper house-keeping at every work-place. According to CDC Act, in every plant, there must be a contractor to maintain the safety policy of the plant (Snider et al., 2014). Every company head must give the contract to some suitable person so that the safety condition can be maintained at a time to time. In the company, if there is fire took place incidentally, a fire alarm system must be installed for that. After studying all the issues, CDC made a report of the problem of the company and advised to take these appropriate actions so that any unsafe condition in the work place can't occur (Steele et al., 2013). CDC considers that these unsafe conditions do not affect only to the employees of the company but also to the public surviving around that company (Tate, 2013). If a company met with an accident then it will affect not only to the workers or the people in the company but also to the entire surrounding. If a big incident happens in the company then it must affect the entire surroundings and decay the natural resources also for a long time period. Who or what is affecting in the accident happens in the company help the head engineer to modify the actions to address the problem because it is affecting the human being and animals also surrounding to the company. It also affects the entire environment nearby the plant (Ugwulashi, 2014). The workers who are working in the company are not properly aware of the miss happenings then how public will be aware of the danger. It is not easy to predict the incident but company head should follow the precautions to avoid the incidents. Company head needs to differentiate between who and what is affecting sue to the miss-happening and then she might take an appropriate decision for the welfare for everyone. According to CDC, if a company head is thinking only about the workers and planning only for the safety of the workers then this issue of an unsaf e condition will not be solved (Ulrich, 2015). CDC advised to analyses the whole firm and the area including surroundings of the company. Without proper analysis, a company cannot be established in any area. Proper inspection by the CDC should be done at time to the time or at the quarterly time span so that the predictable incidents can be stop by using caution (Wagner, Wu Sood, 2014). It is the duty of company head to make the work environment safe and to provide the safety to public as well as workers of the place. The engineer is to be held responsible for the mentoring and prevention of the chemical, biological, and physical dangers through the convenience of the employment locations. The engineer should be incorporating the health standards for disseminating the establishment. He should be guaranteeing the quality management measures for establishing and scrutinizing the regulation aspects of the health and safety issues within the business environment (Abara Heiman, 2014). He should be guiding the inspections of the health and safety plans such that to manage and recognize the momentous loss produc ing disclosure. Maintenance of the workplace and all equipments is also the most important step that should be considered by the engineer head at a certain span of time (Athar et al., 2013). The engineer should be responsible for advising the management to impose the legislations for improving the working conditions for avoiding any accidents and he should be identifying each aspect of the issues related to health and safety issues in the workplace. He should be responsible for covering the healthy and safety regulations over a wide range of basic health and safety issues all around the work place. The engineer head and the management must develop the emergency action plan to reduce the chance of the miss-happens (Baker Insurance, 2014). An emergency plan will be practical and appropriate that can be easily implemented. First, a company head should analyze through all the problems that can be happened in the future and then they should take the decision to make the emergency action plan. An emergency plan implements including all the emergencies that can be occurred in the workplace (Bertels Lawrence, 2016). A manager and the company head must inspect the company site at the certain time interval so that they would be able to predict all the emergencies. So a hazard assessment must be determined. All the machinery and the assets require repairing so the continuous repairing is very necessary (Calixto et al., 2013). Thus, the engineer head should be considering the issues and aspects related to the health and safety hazards such that to make the business environment a better p lace to work in. The head engineer should be following the professionalism and should be abiding by the ethical code of conduct. An unclean work place environment is also an unsafe condition so there must be proper housekeeping at every work place (Dimaggio, 2013). The engineer should be creating awareness in the people for the safety of the men power that must be followed. After studying all the issues, the engineer should be convincing the manager and advising him to take these, appropriate actions so that any unsafe condition in the work place cannot be occur. Work place demands the more safety than other places. So the engineer is required to use the security and safety measures. As the head of the company is consulted with the health and safety control consultancy, that is CDC then it is advised to make use of appropriate things the company (Donohue et al., 2015). If a big incident happens in the company then it must affect the entire surroundings and decay the natural resources for a long time. It is not easy to predict the incident but company head should follow the precautions to avoid the incidents. The management is required to take it is the responsibility of the engineer to advised management to take an appropriate decision for the welfare for everyone. The head engineer must address all the problems, which affects the entire environment nearby the plant. Without proper analysis, a company cannot be established in any area. CDC is the agency that works as the consultancy for all type of companies and the public also. It is a welfare association for the society (Gillespie, Wigington Hong, 2013). For the prevention of the health and safety hazards in the business environment, the company should be installing emergency alert system within the business premises. The installation of emergency alerting system would be requiring huge initial investment for the company (Gulzar Manzoor, 2014). However, it should be noted that this emergency alert system would be helping in predicting the emergency in the working environment such that to make the employees aware of the emergency. This creation of awareness in the employees working in the business environment by the emergency system would be enabling in averting the health and safety disaster that could be occurring if the emergency system is not established without the business environment of the organization (Kol et al., 2014). As we take example of fire, if any equipment catches, the fire then there should be fire extinguisher to control the fire. All the equipments equipment to control the unforeseen situation must be present in the company and every worker of the company must be aware of that. This emergency system would be enabling the employees to be aware of the subtraction such that to respond to the merges situation like fire in an effecting way. This could help the company to prevent any losses, which could be caused if the emergency could not be averted. It is concluded that a plant head must take the appropriate steps to ensure the safety of the natural resources as well as employees. Because it is the responsibility of the company management and the company head to provide a safe working environment to the employees and the employers and to improve the health environment of the company. In short, it is concluded that CDC provides a safe work environment to the public and create the awareness among the people to prevent the disease and improve the safety so a company head should use the above-discussed facts to avoid the unsafe working condition. Of Parents and Children Frances Bacon The joys of parents are secret; and so are their griefs and fears. They cannot utter the one; nor they will not utter the other. Children sweeten labors; but they make misfortunes more bitter. They increase the cares of life; but they mitigate the remembrance of death. The perpetuity by generation is common to beasts; but memory, merit, and noble works, are proper to men. And surely a man shall see the noblest works and foundations have proceeded from childless men, which have sought to express the images of their minds, where those of their bodies have failed. So the care of posterity is most in them, that have no posterity. They that are the first raisers of their houses, are most indulgent towards their children; beholding them as the continuance, not only of their kind, but of their work; and so both children and creatures. The difference in affection, of parents towards their several children, is many times unequal; and sometimes unworthy; especially in the mothers; as Solomon saith, A wise son rejoiceth the father, but an ungracious son shames the mother. A man shall see, where there is a house full of children, one or two of the eldest respected, and the youngest made wantons; but in the midst, some that are as it were forgotten, who many times, nevertheless, prove the best. The illiberality of parents, in allowance towards their children, is an harmful error; makes them base; acquaints them with shifts; makes them sort with mean company; and makes them surfeit more when they come to plenty. And therefore the proof is best, when men keep their authority towards the children, but not their purse. Men have a foolish manner (both parents and schoolmasters and servants) in creating and breeding an emulation between brothers, during childhood, which many times sorteth to discord when they are men, and dis turbeth families. The Italians make little difference between children, and nephews or near kinsfolks; but so they be of the lump, they care not though they pass not through their own body. And, to say truth, in nature it is much a like matter; insomuch that we see a nephew sometimes resembleth an uncle, or a kinsman, more than his own parent; as the blood happens. Let parents choose betimes, the vocations and courses they mean their children should take; for then they are most flexible; and let them not too much apply themselves to the disposition of their children, as thinking they will take best to that, which they have most mind to. It is true, that if the affection or aptness of the children be extraordinary, then it is good not to cross it; but generally the precept is good, optimum elige, suave et facile illud faciet consuetudo.
